Iam an NBFC staff one of my client had issued me an cheque 2 years before , it belongs to ANDHRA bank and now that this bank is merged with UNION BANK OF INDIA, Can i submit an Negotiable Instrument Act 138 with that ANDHRA bank security cheque or what are the legal options can do against him

A.Dear Sir,

Yes, at the time of issue in cheque the said Andhra Bank was in exitance & on his merging all its liabilities of its Costumers binding upon Union Bank of India.

A.Dear Client
If the cheque issued by Andhra bank is still being honouerd after the merger then you can take the advantage of cheque bounce and file a cheque bounce case when it is dishonoured. Else you will not be able to file 138 case.

A.Dear Client,
You are left only with a civil action against your client now. The Cheque of ANDHRA BANK if presented now will return with a memo citing reason whcih will not be covered under the clauses to enable you to file what you call as cheque bounce case.
