I have a son. And I want another baby but my husband doesn't. He has forced me for an abortion also. What are my legal rights related having another kid?

A.Hello,

As per the facts which had been provided, your husband can't force for abortion because as per law a husband doesn't have the legal right to force his wife for abortion without her consent.

A.Though it is the sole decision of both the husband and wife whether they want to conceive another baby or not, but no husband has the right to force his wife to do such a wrongful act of abortion which is illegal in India. You should definitely complaint against your husband before the local police authority against such inhuman activity of your husband otherwise you may take your husband to a good family counselor for convincing him to take another child, only if, both of you can provide good upbringing to both the children in future including their studies and other necessities because having two children is not a crime but knowing that you do not have the adequate ability to up bring both the child equally in a good environment at the same time due to lack of financial capacity then it is a very big crime as you cannot hamper the future of anyone knowingly and intentionally.
