Is someone with mild depression considered to be of unsound mind ? Is someone with mild depression considered to be of unsound mind ?

My grandmother made a will before her death , it is a registered will. She was a very strong and intelligent woman. Even in her 80s her used to manage the household and worked as a managing director in her hospital and her school. But during the last few months of her life she had mild depression and was prescribed a tablet by her own son (A psychiatrist). She mainly complained to low mood and less sleep. Even while being on the tablet she would go for meetings and do other work from home like inquiring about the school and other things. Now she has left most of her property to me , her grandson. But i think my uncle who is a psychiatrist is going to try to prove that she was of unsound mind. My question is does having mild depression fall under the definition of unsound mind ?

A.Hello Sir,

As per the facts which had been provided, if at the time of signing the property papers grandmother was not in a state of mind to understand the nature of consequences then she can be considered of unsound mind and the document can be considered void but the same has to be proved in the Court.

Hope this clarifies your query and requirement.

Thank you.

It is not unsound mind but such person not aware of on which document he is signing and what are the consequences are such document. Thus, if challenged such document may be treated as null and void.
