Hi Team ,
My employer have paid variable pay tom me last month and now as I am in notice period they are asking to refund that amount , would like to know legal matter on this as this variable pay out is for last year and I have worked full . Thank you

A.Hello Sir!

As per the facts which have been provided, the law states that the employer has the right to reclaim the overpaid sum back. However, employees and workers are protected under section 13 of the Employment Rights Act,1996 for any unlawful deduction from their wages. Your employer can only ask you to pay back money if it’s for something you’ve specifically agreed to in writing.
