My father brought housing loan from credit cooperative society in 2015, at the time of taking loan bank representative mislead us for EMI amount , at the time of taking laon we told to bank , we couldn't afford EMI more than 10000 per month , the bank representative said it's okay , but after disbursement of loan and starting of EMI we realize we got cheated , but my father ignored it at try to sell the property , but after trying to sell this property we didn't get customer for right value , in the last month my father died due to heart failure, from 2015 to December 2021 we paid half EMI 10000 (Exact EMI is 20000) , but bank charge high interest with 2% on due amount , bank credit our money about 6 lakh, but did not less it from EMI, they just created in account , didn't less any EMI , they never send any Notice from last 7 years , they never put our loan account in NPA , now due loan amount with interest is more than property rate , I don't have resources to pay loan , I am unable to think what to do , I also doubtful on bank , I think they want to take illegal possession of my property and sell it or dispose it however they want and grab profit and settle in account with minimal amount , I know we did a very idiotic work , I am requesting to all advocate sir please guide me , what should I do ?, Can I surrender property to bank (credit cooperative society) of file a civil case or fraud case as IPC contract act of misleading case against bank , please guide me sir

A.Dear Sir,
First come out of the loan transaction by settling and thereafter approach the Police with available documents and also file Civil case any huge compensation for misleading you.

A.Dear Client
It seems that the bank has committed deficiency of service related to your account and bank loan. what you can do is lodge a complaint with the banking Ombudsman and also file a case in consumer forum against the bank.

A.Dear Client,

As per the facts which have been provided, you can send a Legal Notice to them and if nothing is done after that as well then you can hire an advocate to file a Consumer Forum Case.
