Hi I m hindu religion girl married to sikh person before 25 years and my father was against this relation. Now this year he died and he made a will for his properly and all to my mother and brother name. Question is there my mother want to give some share form her share but my brother and his wife are against this and dominating my mother buy emonatinal thing so she is worried under them, I need solution for this should I go for any legal process or what should I do.please guide me. Reply soon. Thanks
A.You should not participate in the writing of the will by her in any manner, else will be invalid. Just she has to inform you who has custody of will.

A.If your mother is a senior ciziten lodge a complaint before the CP Office . They will call your brother & his wife for councelling & advice suitably or alternatively you can file a case for your legal sahre in the property & can chellenge the will on any of the grounds and claim your share in the property.

A.Ask your mother to lodge a complaint in the local police station for domestic violence against your brother and his wife. Ask your mother to shift to your place. Once she is with you, get a gift deed of her share in the property.
Alternatively challenge the will of your father on ground of fraud, undue influence etc. If you are successful, you will get equal share in your father's property.

A.You have many options.1. You may give protection to your mother and get your share.2.you may also challenge the will( but that is to be done within 3 years from the date you became aware about the said will.3. You may also get a civil suit by your mother by taking her into your confidence

A.You have no ground to go to what you call as legal process because as you say your brothers are emotionally dominating your mother. There is one thing your mother can do, that is instead of partitioning the property with giving you a share now and inviting the displeasure of your brothers, let her write a will.
