I Petitioner Husband won the contested divorce case and in the judgment the court has mentioned that respondent wife hardly resided for 2 to 3 days and both are living separate for more than 5 plus years.

Her crpc 125 case is filed out if jurisdiction and her documents are faulty with false information on records.

What benefit i can take in crpc 125 based on my divorce judgment.

Please let me know. It would be helpful.

A.Dear Sir,
Your divorce judgment can be produced before Magistrate and convincing that there is no effective marriage and there was no relationship between husband and wife so saying you may get dismiss 125 proceedings summarily.

A.Dear Client,

As per the facts which have been provided, if your wife has claimed for Maintenance u/s 125 CrPC then the judgement will be based on various factors. You can counter her claims in the court by approaching a good advocate.

There is not much of the effect on the maintenance case from your divorce case except the facts and the order as part of your information to the case. Depending on the divorce case you can build your argument against the maintenance case to counter that.
