Need Advice on cancelling home booking after the sale deed is signed.

Hi all, I have booked an apartment in 2020 by paying 5% of the total amount under Subvention scheme. The loan was sanctioned and disbursement has commenced. The handover is in December 2022. But the initial handover data in sale deed is December 2021.
Under this circumstance, can I cancel the booking because the handover is 1 year late , without forfeiting booking amount ?

Before the sale deed is executed and registered there must be an Agreement for Sale (or Sale Agreement). You need to look into the termination and cancellation clause of the same and depending on that you can pursue further.

The RERA empowers the homebuyer to cancel an allotment of the apartment booked with a builder at any stage even if there is no default on the part of the developer. It binds the builder to return the money collected from the buyers within 45 days of such cancellation after deducting the booking amount.

Yes, you can cancel the same and also claim huge compensation as you have been prevented from purchasing another property. You may file a petition before consumer court.
