A.Dear Client,
If salary is not paid, you may Initially write to your HR department in a soft tone to look into the matter
If it does not work out, you have to send a demand notice by yourself or through lawyer to the employer and give your employer a time frame to pay the salary. Ideally salary is to be paid by 7th to 10th of every month.
If the notice does not work, you have to approach the court. Salary can be recovered under Industrial Disputes Act, Shops & Establishment Act, Payment of Wages Act etc. It depends on the nature of your employment as well as the nature of the company.
