A.Dear client as per Order 23, Rule 1(3) of the CPC if a plaintiff desires to withdraw from the suit with liberty to institute a fresh suit in respect of the subject-matter of such suit, then such plaintiff must seek the permission of the court in its application for withdrawal. Under Order XXIII of the Code of Civil Procedure deals with the withdrawal of suits. A suit can be withdrawn any time after the institution of the suit, but not after the judgement is delivered and execution proceedings are initiated. The withdrawal of a suit takes place with or without the permission of the Court.
