Property NPA having title suit
Sir,
I have a property that has gone in NPA. I bought this property in 2005 and I had a CC loan with a Govt Bank since then. In 2012, I closed CC. And in December 2013, I took a new loan in OD format. Since then, I have been paying EMIs.
In between, it came to my notice that in 2014, the broker added a title suit on the property. The document he is showing in court is INR 100 Stamp paper with a fake signature. The agreement is dated February 2013. This came to my notice in 2015 when I saw a newspaper ad regarding the case.
When the bank team got to the site for attaching notice, they also noticed an illegally built building (in some part of the land). And a notice stating this property is under title suit.
Now the bank is saying that they may put an IPC 420 case against me and against the alleged buyer. And since it's difficult to take possession of this property, they will take control of my father's property as he is the guarantor.
I have never done this agreement. Original registry and mutation are with the bank only. What can happen in this case? My only ask is that the bank tries to take possession of the property. I have submitted the original and right paper to the bank.
You are in difficult situation since the Bankers may attach your father’s property but they cannot register any 420 case against you if registered you may go to the High Court and get it quashed.
