I am central govt officer and my tenant neither paying rent for last 8 months Nor vacating my flat. In my 11month agreement on Rs.20 stamp paper it is clearly mentioned to pay rent on 5th of every month. But not mentioned what action to be taken in case of default of payment. But one clause mentions that owner/tenant can give 2 months notice to vacate the flat. 11month of agreement ending 8n sep 2022. Please advice how can I get dues rent payment and to get the flat vacated. My tenant is a builder/developer.
Already served one notice in May 2022 to pay dues rent or vacate. Also disconnected his electricity supply from cesc. Already served one notice in May 2022 to pay dues rent or vacate. Also disconnected his electricity supply from cesc.
One month back he promised to pay entire dues and vacate the flat by 10th July. He again asking for one more month. This way he is delaying from beginning.

A.Dear Sir,

You may file a suit for eviction and thus get vacant premises and also pressurize him to pay the arrears of rent failing which the court may not allow him to contest the case which may be filed by you.

A.Dear client sorry to hear that. Living or even extending your entry into someone else’s property without or against his consent is an offence of trespass.
If your tenant has neither given the rent for a long nor is vacating the house, then you can approach a civil court for damages for the loss which he has suffered due to the problem, both physical as well as mental.
