Mutually divorced in 2020, After fighting for two years in court for the cases of domestic violence, child maintenance Filed by me and divorce case filed by my ex husband. I am mother of a 6 ye old girl.

We made a Compromise deed that states if I remarry my daughters custody will automatically be given to my ex plus he can file for custody of my daughter anytime. But I am not married and Now I want to go and settle abroad with my daughter but my daughters passport Is with my ex and has to be renewed but my ex is not giving it. There are no orders from the court either for divorce or for the custody it Has been mutually decided.

I am a Hanafee Muslim so I want to ask you what are the chances that I will be I have the custody and what are the risks of him filing a custody case and what are the chances of him winning it. Compromise deed also states that he has to maintain our daughter and bear all the expenses of education daily life expenses et cetera and I too have left no stone unturned to give her good education a good lifestyle I’m think about the welfare of my child as I made her study in a very good and one of the top schools in my native

what should I do ? please help thank you

A.Dear client, I am sorry to hear that. However in thus case you can go first and file the child custody petition before the court. But in case the compromise is based on a written contract you can obviously present it to the Court and seek the remedy desired.
