Illegal modification of building

Sir
My building is 30 years Old
The society is formed 1 year back
The builder has not provided toilets inside the flats from the ground floor to the 5th floor. It is the common toilet for every member.
The toilets are provided by the builder from the 6th floor to the 9th floor.
The building has only 9 floors
One of the 4th-floor member wants to construct a toilet inside.
Can that be allowed?

Now after 30 years you cannot claim any relief against your builder as it is time barred however for litigation sake yourself and others may get issue a legal notice and proceed in the Court.
