My wife and I adopted a male child
Sir/Madam, my wife and I adopted a male child a few years ago under Hindu act. Unfortunately the boy (now 15 yrs legally old) turned mentally disturbed, violent and disobedient 3 yrs ago. We needed to hospitalize him and call the Police as we didnt know how to handle him. He attacked us and broke many valuables. The mother buys him whatever he wants. He is angry now that we have hospitalised him and made him a mental patient and called the police on him. He is still minor. I've tried my best to encourage and support him. Occasionally he says he wants to leave us. However the Child welfare committee told us that if he leaves, he will have to stay in a govt home for orphans till he turns 18.
My question is will he complain once he turns major that we did not let him go even though he wanted to? How do I make a legal submission to the govt/court that the child wants to leave us. (Ofcourse he will not leave)
Adoption once completed following the due process of law then it cannot be cancelled by anybody neither the adoptive parent nor the adopted child as per the Section 15 of the Hindu Adoption and Maintenance Act, 1956.
Section 15 in The Hindu Adoptions and Maintenance Act, 1956
15. Valid adoption not to be cancelled.—No adoption which has been validly made can be cancelled by the adoptive father or mother or any other person, nor can the adopted child renounce his or her status as such and return to the family of his or her birth.
Thank you so much, I hope this answer helped you.
The medical records are sufficient to protect yourself even if he lodge complaint against you. It is not a serious matter.
