Hi. Our apartmrnt has 8 flats and it is not a registered society. One of our owner has some pending amount and he is not paying that for one year but paying maintenance from the continuance. Even when the motor damaged, we paid the complete amount. What action can take? He even installed camera with dual audio without anyone permission and he is disturbing everyone not to even walk through his parking. But he uses everything as his own

A.Dear Client
You need to first of all set up a society and get that registered with the registrar of the societies. While getting registered you will need to prepare the byelaws of the society wherein you can mention all the rules and penalties about not following the rules and accordingly you can take action against him.

A.Dear Sir,
Since it is not registered so you have no authority against him. However you all remaining people may form an association and fight against him for recovery of maintenance amount

A.Dear client,
First, the association can ban the members from using the facilities until the charges are paid. Later, the apartment association can send a legal notice asking them to pay the maintenance charges and if they still fail to do so, then the association can file a case against them. CCTV with audio is an invasion on your privacy. He cannot install it when there are 7 other flats and you can ask him to remove it.
