My wife want to file an dowry case against me . She is an working women's and she sent me money on various time in my account now on basis of those transactions she wants to file an dowry case against me . How to takle this situation

A.Dear Sir,
It is a very weak case for her since towards the family expenses she has contributed such amounts into your account it may be fall within the definition of dowry. However if any false FIR is registered against you then get anticipatory bail first, then approach High Court for stay of investigation and quashing of FIR.

A.Since your wife have sent you money in your bank account so she can easily prove that you have have forced her to pay money for your own use. It will be good for you if you can manage to pay back the total amount she have paid to you till date and make sure that you pay the total money in her bank account only so that you have the evidence that you have returned back her money. Otherwise she will definitely claim that you have forced her to give dowry which is punishable under the law of our country. You should have a proper discussion with your wife that what she exactly wants from you without filing any false criminal case against you. Get it settled amicably.

A.Hello Client,

In the Dowry Prohibition Act 1961, there is a clear provision made in S. 7 that no Court shall take cognizance of any such offence except on a complaint made within one year from the date of the offence.

You can have a conversation with her and if possible you may transfer most of the amount back to her online so that she becomes unable to lodge a complaint.

A.Hi client,
Yes, this very much attracts a case against you. If he and her family members claim this to be a dowry amount charged by you and your family, it can bring trouble for you. She can lodge a 498A against you , with the help of such transactions.
It is advisable to settle it mutually /amicably.
If still you are not able to solve the same, apply for anticipatory bai in the High court or the Sessions court.
