We have planted arecanut trees 3 feet away from the boundary line of our agricultural land. As arecanut is a smaller root tree this will not cause any hinderance to our neighbour with a gap of three feet from boundary. But our neighbour has planted deep root coconut trees right on the boundary line which will be a problem for us due to long branches of coconut trees once it grows. They will fall in our land and the shades also will affect out crops. They are trying to create nuisance every time we try to make them understand. Is there any law with details on the spacing to be maintained for planting trees in boundary lines? What is the right course of action to take on this?

A.Dear Sir,
U may go to the court and get an injunction against the other party not to plant and grow the coconut trees whose roots may enter into your land and destroy the soil, further the leaves may enter into your field and thus u can't grow any other crops under the shadow of coconut tree leaves. U require a very intelligent advocate to get an injunction order.

Thank you Sir. They have already planted the coconut saplings. Can a injunction order be issued to remove the plants until a final decision is made on the case?

A.Dear Client
There is no specific laws on this and as long as you are planting a tree in your land no body is going to bother you. In case his planting of trees is going to hamper you and your land/crop then you can take this dispute to the arbitration or court for settlement.
