My parents want to adopt a girl age 25+ , she has been taken care by my parents from her early child good as her parents were separated. She has a consent even my parents want to adopt her. Is it legally possible to adopt at this age ?

A.In India, the legal age for adoption is 18 years. However, there is no upper age limit for adoption, and it is possible for adults to be adopted if both the adopter and the adopted person consent to the adoption.

If the girl you mentioned is above the age of 18 and is willing to be adopted by your parents, they can file a petition for adoption under the Hindu Adoption and Maintenance Act, 1956. The Act provides for the adoption of children as well as adults, provided certain conditions are met.

Some of the conditions that need to be fulfilled for an adult adoption under the Act include:

Both the adopter and the adopted person must be Hindus.
The adopter must be at least 21 years older than the adopted person.
The adopted person must be of sound mind and capable of understanding the nature and consequences of the adoption.

THE HINDU ADOPTIONS AND MAINTENANCE ACT, 1956. [Act No.78 of 1956][21st December, 1956].

Men who are unmarried can adopt as well as long as they are not a minor. However, if a man were to adopt a daughter, the man must be twenty one years of age or older. Only unmarried Hindu women can legally adopt a child. A married woman can only give her consent to adoption by her husband.

You may get register an Adoption Deed under the provisions of above Act and thus get instant adoption.
