Property Share hand over
I have one property shared by my husband. There is a bank loan also. So documents are in bank. Is it possible to sell my share to some one else. If not can i give a power of attorney of my share to someone else? Since we are divorcing how can i sell my share as he is not ready to sell.
A.If you own a property jointly with your husband and there is a bank loan on the property, you can sell your share in the property to someone else. However, you will need to obtain the consent of the bank to transfer your share to another person.
You can also give a power of attorney to someone else to act on your behalf and sell your share in the property. The person you appoint as your attorney must be someone you trust and who is willing to act in your best interests. You should also ensure that the power of attorney is drafted and executed correctly, and that it complies with all legal requirements.
If your husband is not willing to sell his share in the property, you can still sell your share to a third party. However, the third party will only be entitled to your share of the property and will not have any rights over your husband's share.
If you are going through a divorce, it's advisable to consult a lawyer to understand your rights and options. The lawyer can advise you on how to proceed with the sale of your share in the property and can also help you negotiate a settlement with your husband.
thank you

A.Dear Sir,
If it is divisible then you can sell your portion of property but it might be jointly purchased without demarcations as such you cannot sell your property until your husband agrees for the same. You may get issue a legal notice to your husband and settle the matter.
