I have filled a case in MSME in May 2019. Respondent has not appear in this case till Dec 2022. What now on 30 March 2023 council for respondent appear when the said case is just near to decide as ex party. Now can I claim for cost because of knowingly delay by the respondent?

A.Dear Sir,
Yes, you can claim cost but not it may be only meager below Rs.5,000/-. Let it be decided on merits so that it cannot be remanded back since it was ex-parte.
