A.Dear Client,

The kid will be getting the Overseas Citizenship of India either when both the parents are Indian or one of the parents is the citizen of India. As per the new OCI rules brought in 2018, Foreign spouses of Indian citizens now have a higher chance of receiving privileged OCI cards, which provide multiple entry, multi-purpose visas, and lifetime visas for travel to India.

But as you said, the marriage did not take place, so it may create complications when you will be applying for OCIs and VISAs. Marriage Certificate from the Registrar of Marriages is mandatory for VISAs and immigration purposes.

Please seek an expert legal advice over immigration laws.
