A.For immovable properties you should apply for the Letter of Administration, as Succession Certificate are for movable or liquid assets such as provident fund, bank deposits, shares, loans, or other securities. Contact a local lawyer from Vidhikarya.

A.All children including daughters of deceased father and your mother i.e., his wife also legal heirs. Presently you have no right to sell over the property, until you get legal heir certificate/succession certificate from court. See here observe Tahsildar is not competent to give legal heir certificate, only courts can give legal heir certificate/succession certificate. Without Succession Certificate you have Right on the deceased father's property. Means it is not dispute, only approaching court to declare all the family members including wife are the legal heirs. Death Certificate, Property Documents original or certificate copies, market value certificate, ECs, Two witnesses, Ad in local newspaper, family members ID Proofs are required to apply. Here you remember children of divorced wife/children of deceased wife also have 100% rights along with 2nd wife children.
