A residential plot+bunglow in possession of 2 of 3 married siblings and our stepmother which was inherited by us from our mother's natural death (father released his share), now as sole co-owners of it we wish to redevelop it into apartments to have individual units, however one room and kitchen is in shared possession of our disputed stepmother who's shared household also it is after marriage to our father. She have filed a DV Maintenance case on flimsy grounds, she is also a working professional as teacher with salary and pension. What duty do we have towards her has adult children and how can we achieve redevelopment of the property without any dispute\stay or hinderance from her side and how can she vacate the premises legally just for demolition and construction?

A.Dear Client

As co-owners, you have the right to redevelop your inherited property, but legal steps need to be taken to ensure your stepmother vacates the shared area. Consult a lawyer for legal advice and proceed with empathy. You may serve a legal notice and file an eviction suit if necessary. Since your stepmother is a working professional, it is unlikely she will be eligible for maintenance. Consider providing her with an alternate accommodation during the construction period and offering her compensation to avoid legal disputes and maintain a cordial relationship. Please seek an expert legal advice over this matter.
