A businessman on Facebook does not belong to our community but has been advertising that he is our community person. Also, we have his personal page where he writes erotic content in his regional language. There are a number of reports that he uses a lot of fake accounts to get more likes and comments on his posts. Also, he claimed openly that he did sex chats. So, we started posting about this person everywhere with his photos and penname(We dont know his married status/location/phonenumber/original name nor we have any proofs). We made a number of derogatory comments about all the above including his relation with his wife and daughter. We only wanted to warn people about his duplicity and his love for erotic poetry. We have claims from few people that he used abusive language against them in the past for various reasons. He uses abusive language in his personal wall against few people. Can he make a complaint against us for defamation? If so, what is our defense?

A.1) Criminal Defamation Case

A.dear client kindly Lodge a complaint against the person U/S of IT Act before the cyber crime police.The you have two option 1) Criminal Defamation Case 2) Civil Defamation Case.

Lodge a complaint against the person U/S of IT Act before the cyber crime police.The you have two option 1) Criminal Defamation Case 2) Civil Defamation Case before the competent court.

A.You should know & understand all your action is in record .You should use extreme diligence and caution in posting in face book or any social media.Now the ball is in your Court you should stop and restrain from posting in social Net work sites,It is better take advice & help from a Cyber Crime expert Lawyer to protect from your earlier action. The opposite party is businessman can sue you or put you in a difficult situation.

A.A wrong done by one person cannot be corrected by the wrong done by other person. If someone stabs you with a knife then you can not stab him later (at the heat of the moment as self defense is ok) and say that you are not guilty of crime. So there will be two case one for him that he stabbed you and second for you that you stabbed him.
Please understand that he may sue you for defamation as you would right to sue him for vulgarity and cyber offenses. Will suggest and advise you to stay away from activities as they may land you into some kind of trouble.
