Service Matter - I was selected in the Group B non Gazeted Post pay scale

Sir i was selected in the Group B non Gazeted Post pay scale as per 5 CPC (5500-150-8000) central govt department MES in the year 2005 thruough passing the exams conducted by Department . Appointment letter was issued based on panel seniority maintained by the department and seniorty list of candidate who joined the service was first prepared based on panel seniority but during the year of 2012 . A seniorty list prepared by department for next promotion Group B Gazeted post in the same cadre ( as per 6 CPC pay band 4600)and during the preparation of panel of promotion the seniorty list at the time of was joining was changed and panel was prepared taking the date of joining of the candidate.

Due to this the candidate selected in the same panel at the time of recruitment come above me in the seniorty list at the time of first promotion.

Now i hv passed 10 Years in the service and due for promotion to next post and due to stagnation in promotion.I am not getting the promotion timely but the person who was below in panel now getting promotion before me. I need a legal advice from you

1) weather any rules says that panel seniorty supersede the date of joining seniorty at the time of joining service.

2) can i now appeal to department to change my seniorty after passing the eighteen years service .

3) What is the policy under which i can appeal to court.?

Please give your valuable advice.
