Regarding Variable Payout

I left the company on 3rd April. I am working here since 1 Novemeber, 2021. My Complete 1 year variable is pending. Now After leaving the organization when company needs to settle me variable payout so they gave me a rating of 2 and giving me the reason that your performance is not upto the mark that's why we are not paying your variable. May I know how can I push him to pay my variable payout.

Is the variable payout is performance linked to your terms of employment.? In case it is not performance linked then the Company cannot deny your claim on the ground of sub-standard performance. Reach out to the Office of Labour Commissioner concerned and represent your concern suitably before the Authority for redressal of your grievance failing which you may file an application u/s.33C(2) of I D Act before the Labour Court claiming unpaid dues from the employer. Hope suggestions may work in your case.

As per the information you have mentioned you need to send your previous employer a legal notice seeking the variable payout and if they do not do that then you can also file a case in civil court if the amount is substantial.
