Dear sir, my 4 month salary is due in my previous company. I leff the company as it was not able to pay the salary regularly and also in time. It was a private limited company. I was given a joining letter in which employer had to give one month notice and employee had to give three months notice. My salary was in excess of 50,000 p.m. It was a teaching job in a private Educational Institute.
Also during my 16 months of employment company deducted the TDS but did not deposit to the government. How can I use this activity of the company to pressurise them for speedy recovery of my salary dues?

Can I approach labor court?
Can I get relief under Payment of of wages Act 1936?
Can I approach Labor Commissioner under section 12 of ID Act?
Can I lodge a cheating case to put pressure on the employer?

PLEASE TELL ME THE MOST APT PROVISIONS OF LAW under which I can see the payment of my pending salary from my previous employer.

A.Dear Sir,
All are important but last one is more important.
Secondly, while writing do not forget to mention about your TDS and Tax evasion
on the part of you former employer.

A.Dear Sir,
You can approach the Labor Commissioner and if he cannot resolve then refer the dispute to Industrial Tribunal under section 12 of ID Act.
You can get issue a legal notice and file money recovery suit. For legal notice contact me.
