Ancestral property - We have one killa of our ancestors in state haryana
10 months ago
We have one killa( ancestral land) of our ancestors in state haryana. That killa was in name of my grandfather now after my grandfather’s mom died. But my grandfather is saying he do not want to give any part of that ancestral land to my father due to some internal matters. If my father files case legally, can he get some part of that land? Or he can't unless my grandfather won't approve to give him
A.Dear Client.
In the case of ancestral property, your Grandfather cannot deny the share of your father or transfer the title of property even by will without the consent of other legal heirs/coparceners who got the right of an equal share of the property. Your father being the legal heir/coparcener of the said ancestral property can file a suit for partition of the property to obtain his share in the ancestral property. In case you need proper advice or further assistance in the matter you may contact our legal team with the relevant papers.
