In a case where the proceedings are going on and the opposite party dies, having no whereabouts or any information of the legal heirs, then what can or needs to be done to find out legal heirs. Further what happens if there are no legal heirs, what application can I make ?

A.Dear Client,

The court should be informed of the death of OP and as per the order of the Court necessary steps to be taken by the Registry to find out the legal heirs/representative to continue the proceedings. If no heirs or representative of deceased OP is traceable, then the case may be heard exparte and order may be passed accordingly.

A.Hello,
As per the information you have mentioned , there can legal representatives of the deceased who can carry on the case on his behalf.
