Hi sir,
My husband is having so many affairs. He is not interested on me either in family life or in physical life. He tried som any times for divorce but ibrefused to give. Now he left the house and living separately. I am having 10 years daughter. I need my husband back. How can i take him back by legaly saying to him. Please help me

A.Dear Madam,
First try to ascertain if your husband is married to somebody else.
If it is the case then file a Case under 494 IPC for bigamy.
Next step is file a case in the family Court for maintenance of self and 10 year old girl .
Next step would be to file another case U/S 9 of HMA for restitution of conjugal rights.

Legally you can file restitution of conjugal rights petition in the family court where you or your husband resides or where you both last lived together or where the marriage happened, with the help of a local lawyer after understanding about the pros and con of this case.

Your husband is not an object which you will get legally.
Now coming to your point if he is having affairs with so many then ask him to stop or if you want to stay with him with that habit you have to tolerate.
If he is not staying with you means he is looking for other options.
Under the circumstances, file a case for divorce so that both of you can have your own life.
So far Divorce is concerned if you can have divorce with mutual consent then your problem can be solved within 6 months.

You should immediately lodge a complaint before the concerned police officials u/s 494 of IPC i.e. for bigamy, if your husband has married to some other lady. Meanwhile, you can file a petition u/s 125 of CrPC, if he is not even giving you the maintenance. You can file a case of domestic violence as per the provisions of PWDV Act. You can file a case u/s 9 of the HMA for the restitution of conjugal rights, if you want to live with him. On the other hand, you can also file a divorce petition u/s 13 (1) of the HMA, if you don't want to live with him. For more information, you should contact a good legal practitioner from the Vidhikarya platform having specialisation in family matters.
