I signed aggrement of dataentry job , the company provide me 700 forms which completed in 7 days , & i completed 698 ,2 forms by mistake submit blank , now they asking me for money 4000 rs for new id , i refused to pay , then company said that they are going for legal procedure as i signed aggrement, They send me this case id "Your legal case ID GJ/9317523 is going for legal proceedings, kindly hire a lawyer and go for further process, we at net scribes solution are going with legal proceedings under section 72,73,74 in the Indian contract act 1872, due to violating the contract, regards,law firm "

A.Dear Client,

If you get a copy of agreement signed by you for getting job of data entry, then go through the condition of the said agreement that empowers the company to claim compensation for breach of any condition by the employee that causes financial loss or damages to the Company for the deficiency on the part of the employee. If there is no such stipulation, then they cannot claim compensation even through litigation. Sections 73 and 74 of the Indian Contract Act, 1872 provide for unliquidated and liquidated damages respectively. Unliquidated Damages are the damages awarded by the courts on the basis and assessment of actual loss or injury caused to the party suffering breach of contract. The words ‘loss or damage’ in Sections 73 and 74 of the Act would necessarily indicate that the party who complains for breach of contract must have really suffered some loss or damage apart from being faced with the mere act of breach of contract. That is because every breach of every contract need not necessarily result in actual loss or damage. So without being scared with the text message of the Company that may be sent to you with ulterior motives to pressurize you to agree with their illegal and arbitrary demand, instead you need to consult an Advocate to get first-hand information on the subject and prepare yourself mentally to face the consequences if arises seeking the service of an Advocate.
