Hi! I joined a company in Pune Last year with a one year bond (I should compulsory work for one year or should pay 3 months salary back if i quit). The company has a probation period of 6 months. I worked for nearly 7 months. I received a confirmation for confirmed employee through email. But i have not responded to it. During my 7 months period, i was harassed by the employee and i was told i will lose my job in the consecutive months. Eventually i decided to look for a new job & found it. I quit the company without serving notice period. Now the company is asking me to pay 5 months salary back( 3 Months + 2 months notice period salary). They have put a case against me in Pune. Unfortunately i have not recorded the conversation of the employer when they harass me. Can you advise me how should i move? Even after leaving the company they are trying to harass me. Need your advice on it.

A.Dear client,
if you have signed a one year bond with your employer, you have to serve them for the entire period, failing which you have to pay fine. If you do not have adequate evidence to prove harassment, it will be a weak case. Please search for other relevant proof

From the content of your query, it reveals that you abandoned the job of the Company without any notice in violation of the terms of the contract of employment that liable you to pay back the salary for 5 months treating the balance of the bond period and two months notice period. Further, abrupt abandonment of service or job by an employee without notice to the employer is termed as misconduct under model standing orders followed in an establishment in the absence of certified standing orders and accordingly you are also liable to face show cause from the employer. In case the Company suffers any damages or financial losses for your abandonment of the job, they can file a suit against the errant employee in Court claiming compensation for such damages/financial loss. So considering all these implications you need to resolve the matter as desired or demanded by your ex-employer to avoid all sorts of unwanted consequences that may affect your future career.
