Property registration - planning to buy a flat in Kolkata

I am planning to buy a flat in Kolkata. My home loan is already disbursed, and i have already paid my down-payment and stamp duty charges and registration fees.
Problem is, My bank said that property will be registered on Monday (26/06/2023) i also informed the same to the Builder but some reason bank said that it will take more 3 days to register the property. Now Builder says i have to pay a penalty (50K) for missing the date. What can I do now?

Since the bank themselves informed that it will take 3 more days to register the property, it was evidently not your intention to miss the date . Therefore, you can explain this nuance to your builder

A Builder on receipt of the agreed value of the flat/apartment is duty bound to register the same in your favour on the scheduled date of registration and for any unavoidable reason which is beyond the control of the Buyer, if the scheduled date of registration is shifted and rescheduled on any other date, Builder cannot claim a penalty for the same from the Buyer and such an arbitrary demand is termed as unfair trade practice. Serve a legal notice on the Builder and if the project of the Builder is registered under WB RERA, or even it is not registered under RERA, then reach out to the office of RERA and file a complaint either offline or online against the Builder for such an illegal and arbitrary demand which amounted to unfair trade practice for resolving the matter ASAP.
