Borrowed Money in 2013 and signed a blank 20rs stamp document. We returned the money in 2015 but didn't get back the document. Now after years he has filled the document saying we recieved 7 lakhs in it and asking us to give the money. What should we do now? Will the 20rs stamp paper be valid in 2023?

A.Dear Client,
There is no expiry date for a Non-Judicial Stamp Paper once it is executed, documented, and registered before an Oath Commissioner. Transaction of money between the parties requires proof of payment and receipt of both parties. When a claim arises demanding a high value of transaction of money, the onus lies on the claimant to adduce the document/evidence behind the high-value transaction which requires documentary transfer either through Cheque or online banking. An unregistered and unwitnessed stamp paper cannot be admitted as an authentic piece of evidence for such a high-value transaction. So, consult with an Advocate for the service of a legal notice to the claimant and for filing a case against the claimant before the Criminal Court for a false claim.

A.Dear client,

Burden of Proof: The burden of proof lies with the person making the claim. They need to provide sufficient evidence to substantiate their claim that you received 7 lakhs. Your lawyer can help you assess the strength of their evidence and determine the appropriate course of action.

Blank Stamp Paper: The validity of a blank stamp paper depends on the applicable laws and regulations in your jurisdiction. In some cases, a blank stamp paper can be considered valid if it is properly filled in accordance with the law. Your lawyer can advise you on the specific laws and regulations in your jurisdiction.

Contest the Claim: If you believe that the claim made on the document is false or inaccurate, you can contest it. Your lawyer can help you gather evidence to refute the claim and present your case effectively.

Negotiation or Mediation: Depending on the circumstances and the relationship between the parties involved, it may be worth considering negotiation or mediation to resolve the dispute. A neutral third party can help facilitate discussions and potentially reach a mutually agreeable solution.

Statute of Limitations: In some jurisdictions, there is a statute of limitations that limits the time within which a claim can be filed. Consult with your lawyer to determine if the claim is still within the applicable statute of limitations.
