I have a MG electric car and have installed a charger in my allotted basement parking space connected to my electric meter. I stay in Gurgaon. Can RWA ask me to disconnect my charger and ask me to charge at public charging station?

A.Dear client,
The authority of the Resident Welfare Association (RWA) to ask you to disconnect your electric car charger and use a public charging station would depend on the specific rules, regulations, and bylaws set by the RWA for the residential complex or society where you reside in Gurgaon. It's important to review the terms and conditions outlined in your housing society's bylaws or any specific regulations related to the use of electric car chargers.

In some cases, RWAs may have guidelines in place that regulate the installation and use of electric car chargers in residential parking spaces. These guidelines might cover aspects such as safety, load management, and sharing of common resources. If your RWA has specific rules prohibiting the installation of electric car chargers or requires the use of public charging stations, they may have the authority to ask you to disconnect your charger.

However, it's also worth noting that there is an increasing emphasis on promoting electric mobility and providing infrastructure support for electric vehicles. Many states and municipalities in India have initiatives and policies in place to encourage the adoption of electric vehicles and facilitate the installation of charging infrastructure in residential areas.

To resolve the issue, you could consider the following steps:

Review RWA rules: Carefully review the RWA bylaws, regulations, and any specific guidelines related to the installation and use of electric car chargers. This will help you understand the specific provisions that apply in your case.

Engage in dialogue: Initiate a conversation with the RWA to understand their concerns and discuss the benefits and feasibility of your electric car charger installation. Explain the advantages of having a dedicated charger in your allotted parking space and address any potential concerns they may have.

Seek legal advice: If you face resistance from the RWA and believe that their actions are unfair or in violation of any applicable laws or regulations, it may be helpful to consult with a lawyer who specializes in property or housing law. They can provide guidance on your rights, the relevant regulations, and potential courses of action.

Explore alternatives: If the RWA insists on using public charging stations, you could consider discussing the feasibility of installing a shared charging facility within the residential complex or exploring options for collaborative charging infrastructure.

It's important to approach the situation with open communication and a willingness to find a mutually beneficial solution. Engaging in constructive dialogue with the RWA and seeking legal advice when necessary will help you navigate the situation effectively.
