A.Dear client,

Regarding the common passage beyond the boundary wall, whether your neighbor has a legal right to demand access to it would depend on various factors such as property rights, easements, and local laws. It is important to review the property deeds, land surveys, and any relevant local regulations to determine the rights and restrictions associated with the passage.

If your neighbor cannot provide any documentation or legal basis for claiming the common passage, it may be worth consulting a lawyer to understand your options and protect your property rights.

Regarding the drain, local regulations and property rights will also dictate what is permissible. If the drain encroaches on the common passage or your property, it may be considered an unauthorized use of your land.
