Opposition demanding Common Passage after boundary wall.

Neighbour demanding Common passage beyond boundary wall. But did not show any deed regarding the same. Also make the last 3-4 feet of their drain in this passage . Is this legal ? Kindly advise. There is already 1kt 6ch. Land is shortage
