We have ancestor agricultural land. One of my uncle's son has hold that land (it is common land and not yet distributed, but he has taken control of all) on few places, and is demanding money to release the hold on the account of expenses his late father has done on that land (with no proper proof). He has quarreled with my elderly mother when we were not at the place. We would like to place a formal complaint to police department (not FIR), as a preventive complaint. Please suggest if this is possible and what sections are applicable.

A.Dear Client,
Ancestral property is equally shared by all the coparceners/legal heirs. So, if the uncle's son has kept the entire ancestral property in his possession outrightly, you need to file a partition suit before a Civil Court praying order of partition in r/o said ancestral property to get back your share in the property. A.Dear client,
This is illegal occupation of property. First, you should file a written complaint with the city's superintendent of police (SP), where the property is located. In case the SP fails to acknowledge the complaint, a personal complaint in the court concerned can be filed.
