Hi.my name is mahesh.I get married and she went to her home after the marriage of one month because she has a past lover so she went with in the one month of marriage when I noticed that she had a lover . So my parents and her parents convinced but she didn’t came back and I’m a tribe ST caste and my village panchayat have solved and she dicided to give divorce so I also accepted but after completing on panchayat again she gave pitition on maintenance issue and harassment from the court but in the customary law we have completed all the divorce issue but again after that she again giving pititions what should I do for this

A.Dear client,
Section 18(3) of the Hindu Adoption and Maintenance Act 1956 clearly states that a wife indulged in the relationships of adultery could not be entitled to ask for maintenance. The word ‘unchaste’ refers to relating to or engaging in sexual intercourse activity or especially of an illicit or extramarital affair. A wife indulged in unchaste activity is denied for the claim of maintenance.
