We had given an order for food truck modification on april 1st. He told he will deliver in 20 days but he almost delayed for 3 months. So for surety we made an agreement on 10Rs stamp paper with terms that if he didn't deliver the food truck in another 15days he should return the complete advance which we had given and we will take the truck with the work done till now. But now the time exceeded and he was not giving the advance amount. Can we file the complaint and recover the amount from him ?
