Hi Sir,
I need advice on a matter of my brother. He is in Judicial custody from last one month. he has been charged by section 408 ,420 , 467,468,471, 120b and 66c IT act. the case is regarding online wrong bank transaction through company account of 90 lac . IO has not submitted chargesheet till yet. What is right time to apply for bail. our advocate asking us to wait for one more month. is there any chance that we will get bail from session court ? or we have to go till high court.
kindly advice.

A.Dear Sir,
Your conducting Lawyer is right.
Police is supposed to file charge sheet within 60 days.
Once the charge sheet has been submitted to a court of law, the court decides as to who among the accused has sufficient prima facie evidence against him to be put on trial. After the court pronounces its order on framing of charges, prosecution proceedings against the accused begin in the judicial system.
You can file for Bail, no problem, but it will be refused. Then you have to go to the Court of Sessions and then High Court. The process goes on.Ultimately it is the charge sheet that matters.

A.Dear Sir,
If charge sheet is filed then the court considers that investigation is closed and there are more chances to get bail easily.
