According to Section 185 of the Motor Vehicles Act, 1988 driving under the influence of drugs or alcohol is a criminal offense. The first offense is punishable with imprisonment of up to six months or a fine of up to 2000 rupees or both. Further, only if a breath analyzer test detects alcohol exceeding 30 mg per 100 ml of blood, an accused can only be convicted for drunken driving.
