First time drink and drive what would be probable penalty
2 weeks ago
What are the chances of jail sentence for the person caught first time in drunk and drive case u/s 185 by Haryana session court.
A.Dear Client,
According to Section 185 of the Motor Vehicles Act, 1988 driving under the influence of drugs or alcohol is a criminal offense. The first offense is punishable with imprisonment of up to six months or a fine of up to 2000 rupees or both. Further, only if a breath analyzer test detects alcohol exceeding 30 mg per 100 ml of blood, an accused can only be convicted for drunken driving. If required, you can consult an advocate for advice and assistance in the matter.
Hope it helps.
Thank you.
