We are having boundary issue with our neighbors in our agricultural land. We have done the survey using Government surveyor but they did not accept the boundaries marked by him. Our neighbors gets into a quarrel with us every now and then and threatens to assault. We already registered police complaint and got CSR on two occasions and those were closed after discussing with both parties. We requested police to file an FIR and go for a case but the Police told as there was no injury they cannot go for FIR. As there wasn't much of a action taken by police, the opposite party still gets into quarrel and keeps threatening us. What is the right thing to do here?

A.Dear client,
This is illegal. If you can't get an FIR registered at the police station, then you can approach the local magistrate under CRPC 156 (3) 1973. Under this section, a magistrate is empowered to order the investigation. 2. A magistrate can take cognisance of the complaint and ask the police to investigate the case and file a report.

Thanks Ankit for the reply. Other concern the police officer has is no proof for the incident, he was asking for video or photo proof. I clearly told not every assault has video as proof. There were women workers in the field who witnessed the incident. If required you can investigate and talk to them.

Assaults or intimidation can happen without any witness or video evidence. On couple of occasions there was no witness at all and my father did not go for any video recording. It was a criminal intimidation trying to hit my father with the weeding tool used in farm. Can police go for FIR or not incase of criminal intimidation without any witness or video evidence and no injury?
