Builder has some car parking distributed without intimation to society. and society also not taken any action against builder. So this valid allotment or not.
A.Dear client,
The validity of car parking allotments in a housing society may depend on various factors, including the terms of the agreement between the builder and the society, local laws, and regulations governing housing societies in your area. To determine the validity of the car parking allotments, you may need to consider the following steps:
Review Society Bylaws: Examine the bylaws or rules and regulations of the housing society to understand the provisions related to car parking allotments. The bylaws should specify how parking spaces are allocated, whether they are reserved for specific apartments or whether they are common areas available to all residents.
Verify Builder Agreement: If the builder had any agreement with the society regarding the distribution of car parking spaces, review the terms and conditions specified in that agreement. This may include details about the number of parking spaces, their allocation, and any fees or charges associated with them.
Check Local Laws: Research the local laws and regulations that govern housing societies in your area. Some regions may have specific laws regarding the allocation and usage of parking spaces in housing societies.
Approach Society Committee: If you believe there has been an unauthorized or improper distribution of car parking spaces, you can raise the issue with the society committee. Request that they investigate the matter and take appropriate action based on the society's bylaws and any applicable laws.
Legal Advice: If the issue remains unresolved and you believe there are significant irregularities or violations, consider seeking legal advice from a lawyer who specializes in real estate and housing society matters. They can help you understand your rights and options for addressing the issue.
General Body Meeting: If the society committee does not take appropriate action, you may consider raising the issue at a general body meeting of the society. Residents can collectively address concerns and decide on the best course of action.
