A.Dear client,

If you have submitted an application to a government authority, in this case, the Zilla Parishad in Maharashtra, requesting information under the Right to Information (RTI) Act, and your application has been refused on the grounds that it is not in the larger public interest, you have the right to appeal the decision.

Here are the steps you can take:

First Appeal: If your RTI application has been rejected, you have the option to file a first appeal within 30 days from the date of receipt of the refusal. The first appeal should be addressed to the First Appellate Authority, who is usually a senior officer in the same department.

Grounds for Appeal: In your first appeal, clearly mention the reasons why you believe the information you requested is in the larger public interest. Explain why the information is essential for transparency, accountability, or for addressing a matter of public concern.

Supporting Arguments: Provide any supporting documents, facts, or legal provisions that justify your claim that the information is in the larger public interest.

Keep Track: Keep track of the timeline of your appeal process. The First Appellate Authority is required to respond to your appeal within 30 days from the date of receipt of the appeal.

Second Appeal: If your first appeal is rejected or you do not receive a response within the specified timeframe, you can file a second appeal to the State Information Commission. The second appeal should be filed within 90 days from the date of the first appeal decision or the due date of the response.

State Information Commission: In the second appeal, explain the reasons why you believe your first appeal was wrongly rejected and why the information you requested is indeed in the larger public interest. The State Information Commission will review the case and make a decision.

Legal Assistance: If you encounter difficulties during the appeal process, you may seek legal assistance or advice from an RTI activist or an experienced lawyer who specializes in RTI matters.

Right to Information Act is a powerful tool for citizens to seek information from public authorities, and public interest is a significant aspect of the Act. If you genuinely believe that the information you requested is in the public interest, pursuing the appeal process diligently can lead to a favorable outcome.
