Hi. We have an independent house with 5 portions where 4 portions are 1BHK for rent.
Initially we gave residence for all family members, this person came as a couple saying he is with a business background and doing social activities and dog rescue in 15 days but we came to know he is not a couple and no proper work to earn, only dog rescue and making money with video upload is his activity.
We agreed for 2 pet dogs to be inside the house and backside balcony.. but he did not sign off on the agreement, bringing additional rescue dogs to home, almost 5 dogs now at home and using the entire corridor from Ground floor to 3rd floor. all front balcony main door entry of all tenants and owner space is getting dirty with dog putty and urines, dog urinating on comman water sump cover.. he is not cleaning and not paying cleaning charge as well, he came to house march 15 in april 20 we said him to vacate but he paid april and may month rent and did not pay june and july rent where rent amount is 7500 only, almost march to july water and electric bill did not pay so his deposit money of 35k is also adjusted almost 3 months time given to vacate he said he will vacate even in police station since he is fighting every alternate days for bescom electric issue and water issue in his house asking us to arrange plumber and solve his work..

since agreement was not signed off by the tenant and this was received from the police station as he did not return the original. also did not pay any payment where all his deposit money was adjusted by this end of july2023. As he is troubling every one, is there any way we can evict this person ASAP. Also complaint on allowing street/rescue dogs inside the rented house without owner permission.

A.Dear client,
After establishing the grounds for the eviction, the following procedure needs to be followed:

Stage I - Send a Notice to the Tenant to Vacate: An eviction notice needs to be filed in a court under the appropriate jurisdiction mentioning the reason for eviction and the time and date by which the tenant has to vacate the property and is then sent to the tenant to vacate the rental property. The landlord must give a reasonable time to the tenant to vacate the rented property. In the majority of cases, the tenants leave the rented premises after receiving a legal notice from the court.

Stage II - File an Eviction Suit: The tenant may refuse to vacate the rented property after receiving the court’s eviction notice and contest the eviction. In this case, the landlord can hire a rental property lawyer to file an eviction suit against the tenant. The suit for eviction of the tenant is filed in a civil court under whose jurisdiction the rented property is situated.

Stage III - Final Eviction Notice: The court hears both sides and issues a final legal notice for eviction for the tenant based on the arguments and evidence present. The tenant has to vacate the rented property once the court sends the final eviction notice.

This is the tenant eviction process in India, however, the eviction of the tenant without a rental agreement is difficult as there is no proof of property being given on rent to the tenant.
