Regarding domestic mental & physical torture.
I have been married 20 years of marriage. I'm a housewife. My in laws have been mentally torturing me ever since I got married (2003) {for dowry, about my family etc). I'm a mother to one child (born in 2005). My in laws tortured me even more after her birth. Even for petty things as milk..they used to drink all the milk everyday while leaving none. My parents kept me for about 10 months because of all this. Even when I returned back to my in laws house my parents used to send milk, dresses etc. My husband used to have a motor parts shop but his brother closed it down. He does nothing now for several years. Our source of income is only rent (8000+ 5000=rs 13000).Both of my in laws( mother and father) died last year. Meanwhile I've been facing mental & physical abuse everyday. Now my daughter is going to go to college & he doesn't arrange the fees. She studied in DPS ranchi..& all the fees through these years were paid by either my father in law or my father or my brothers. I got 10 lakh rupees after my father's death(he used to work in CCL). My brother took that as loan from me to open a mart but he had to close it in 2021. Now since that time every single day my husband tortures me. Even if I tell him to go and buy ration he tells me "jao apna bhai log se maango" & abused me. Every single day. He says "jaise tm udai apna bhai me hm bhi uda denge.. jao apni maa k ghr raho" . Please help me.. I and my daughter have been tired of this. My daughter's future is also suffering because of all this..please tell me how can I get the money for her education? & if i get divorced do I have the right to alimony/ maintenance if my husband does no work. (My husband says "kaam hi nahi karenge toh alimony kahan se ayega?") Is that true? Plz tell plz
You can file a case against him under section 498A of IPC for mental harassment and torture. Protection of Domestic Violence Act can also be used to support your claim.
Recently in a major judgement, Karnataka High Court has ruled that an unemployed husband should find a job to provide alimony to the wife.
