Can a wife get custody of 10-year-old daughter in such a case where the husband leaves the wife because of wife's extra-marital affair?

A.Dear client,
As per the laws on Indian child custody, both divorced parents have equal rights over the child even after legal separation. In case of no mutual consent, the family court will decide who to give custody to. Considering your case, you have a better chance of getting custody. However, one parent winning custody doesn't mean the other ceases to be the parent and loses all rights over the child.
