My senior has been harassing me mentally, bullying me and yelling at me in front of everybody in the office. Even on small point in a mail, he makes it an issue to scream on the top of his voice. I am getting extremely depressed her. He is repeatedly asking me to resign and leave. I have received a confirmation letter and he still asks me to leave. He pass personal attack remarks and ask me to behave in a certain manner. When we travelled on an outing for an exhibition, he persistently expressed me to drink (this was few months back). Anyway, I am tired of his behaviour and his treatment everyday.

A.Dear client,
Cases for mental harassment at work can be filed in both civil and criminal courts if the charge of criminal intimidation under Sec.506 IPC or charges under Sec.504 IPC are added, which states that whoever intentionally insults, and thus gives provocation to any person, intending or knowing it to be likely that such provocation will cause him to break the public peace, or to commit any other offence, shall be punished with imprisonment of either description for a term which may extend to two years, or with fine, or with both.

A.Dear Sir,
You may lodge a complaint with Police or get issue a strong legal notice or send a representation to the higher authorities of your company.

A.Dear Client,
There is no specific procedure provided in any law to deal with mental harassment at the workplace. Since mental harassment has been categorized in various forms under Indian law, the action to be taken shall be in accordance with the particular kind of harassment the victim has faced. Cases for mental harassment at the workplace can be filed against the colleague or Company in the civil court as well as a criminal Court if you add the charge of criminal intimidation under Sec.506 IPC or charges under Sec.504 IPC that says whoever intentionally insults, and thereby gives provocation to any person, intending or knowing it to be likely that such provocation will cause him to break the public peace, or to commit any other offense, shall be punished with imprisonment of either description for a term which may extend to two years, or with fine, or with both. When you are facing such kind of mental harassment at the workplace from the toxic behavior of your senior Boss, you may bring the matter to the notice of higher authorities first and serve a legal notice to the errant Senior of the organization and thereafter you need to reach out to an Advocate for filing a criminal suit against your errant senior and the higher authority for not responding to your notice.
