In fact, there is no explicit legislation dealing with false information or fake news if uploaded on social media. The right to freedom of speech and expression, guaranteed by Article 19(1)(a) of the Indian Constitution, is the fundamental right that encourages the free publication or broadcasting of news. But, the freedom granted by Article 19(1)(a) is not absolute and is subject to reasonable limitations imposed by Article 19(2). In case your company's goodwill is adversely affected by the fake news of your employee or ex-employee, the company can take legal action against the errant employee, and Sections 153, 153A, 295, and 295A of IPC may be used to combat fake news. Action can be taken against someone who creates or spreads fake news if it can be classified as hate speech under the terms of these sections.
